The Educational Rights of Children and Youth in Homeless & Transitional Housing Situations - The BASD Homeless Education Assistance/Families in Transition Program is available to help homeless students succeed in school and overcome enrollment obstacles, as well as access those educational services in which they may be eligible under the McKinney-Vento Homeless Assistance Act.
The McKinney-Vento Homeless Assistance Act is a federal law that was created to make sure that homeless/transitional housing students have access to the same opportunities as non-homeless/transitional housing students, so they can be successful in school.
The McKinney-Vento Homeless Assistance Act defines homelessness as "lacking a fixed, regular, and adequate nighttime residence". Some possible living situations of homeless students could include:
- living in a shelter
- doubled up with another family due to economic disadvantage or loss of housing
- living in a motel/hotel, unsheltered (i.e. living in a car, campground, abandoned building, etc.)
- a student who is temporarily staying with friends/family other than with their parents/guardians who qualify as homeless because they are living in similar circumstances listed above
- students who are unable to live with their parents due to conflicts or other reasons who qualify as homeless because they are living in similar circumstances listed above
- migratory children who qualify as homeless because they are children who are living in similar circumstances listed above
